Terms of Service

These Terms govern your use of Notch, a macOS application developed and licensed by Ibraheem Farooq ("we", "us"). By downloading, installing, or using Notch, you agree to these Terms.

1. The app

Notch turns your Mac's notch (or a floating pill on notchless displays) into an interactive panel: Now Playing, volume/brightness HUDs, a file tray, calendar/weather widgets, dictation, sticky notes, and system notifications. Some features rely on public, undocumented, or private macOS behavior (e.g. reading system HUD state) to achieve a native look; Apple could change this in a future macOS release and break a feature. We'll do our best to keep up, but this is provided "as is" per §6 below.

2. Trial and purchase

• Notch offers a 72-hour free trial with full functionality, starting from first launch.
• After the trial, Notch is a one-time purchase of $14.99 USD, licensed per user for up to 3 Macs (activations) at a time. You can deactivate a seat yourself from Settings or Polar's Customer Portal to free it up for another Mac.
• Purchases are processed by Polar Software, Inc., acting as Merchant of Record and authorized reseller. Your purchase is subject to Polar's Buyer Terms in addition to these Terms; where the two conflict on payment/checkout matters, Polar's terms govern the transaction and these Terms govern your license to use the software.
• Refunds: we offer refunds within 14 days of purchase. Contact ibraheemfrq@gmail.com or use Polar's Customer Portal to request one. (Note: Polar may independently issue refunds proactively to prevent payment disputes, per their own policy. This doesn't reduce your 14-day guarantee; it's just how their fraud/chargeback prevention works.)

3. License grant

Subject to payment and these Terms, we grant you a non-exclusive, non-transferable, revocable license to install and use Notch on up to 3 Macs you own or control, for your personal or internal business use. You may not: redistribute, resell, or sublicense the app; reverse-engineer it beyond what's permitted by law; or use it to build a competing product.

4. Updates

Notch checks for updates (via Sparkle) and, if you choose to install one, downloads and applies them. Updates may add, change, or remove features. Your license carries over across updates automatically.

5. Privacy

Our Privacy Policy describes what data we collect and how. It's incorporated into these Terms by reference.

6. Disclaimer of warranties

NOTCH IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH FUTURE MACOS VERSIONS, PARTICULARLY FEATURES THAT RELY ON UNDOCUMENTED SYSTEM BEHAVIOR.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF NOTCH, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE.

8. Termination

We may terminate or suspend your license if you materially breach these Terms (e.g. redistributing the app, chargeback fraud). You may stop using Notch and uninstall it at any time; purchased licenses are not automatically refunded upon voluntary termination outside the refund window in §2.

9. Governing law

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your own country/state gives you additional rights that cannot be waived (e.g. EU/UK consumer rights, US state consumer protection law). Those rights are unaffected by this section.

10. Changes to these Terms

We may update these Terms from time to time; continued use of Notch after an update means you accept the revised Terms. Material changes will be noted in the app's release notes.
